1. Overview

These Terms & Conditions govern your use of the Deluge Beautee LLC website and booking platform (delugebeautee.com), including our AI Nail Advisor tool, booking system, Deluge Collective features, Deluge Spaces, and all related services. By using this website, booking a service, or joining as an independent Artist on this platform, you agree to these terms in full.

Deluge Beautee LLC ("Deluge Beautee," "we," "us," or "our") operates as a beauty service platform. We provide independent beauty professionals ("Artists") with booking technology, client communication tools, and brand infrastructure to run their own businesses. Deluge Collective and Deluge Spaces are sub-platforms operated under Deluge Beautee.

2. Platform Nature: Independent Contractor Relationship

Deluge Beautee is a platform, not a staffing agency or salon employer.

3. Artist Onboarding

Artists join the platform by completing Deluge Beautee's onboarding process. By joining, each Artist agrees to these Terms & Conditions in full, including all Artist-specific provisions herein.

Deluge Beautee reserves the right to deny, suspend, or terminate any Artist's access to the platform at any time, for any reason, including but not limited to violation of these Terms, client complaints, misrepresentation of qualifications, or conduct inconsistent with platform standards. Platform administrators designated by Deluge Beautee LLC are responsible for platform oversight.

When operating under the Deluge Beautee platform, each Artist agrees to:

5. Platform Fees

Deluge Collective: Free During Beta

During the Beta period, Deluge Collective charges Artists no platform fees, commissions, or subscription costs. Joining is free, and Artists keep 100% of their service revenue (minus any third-party payment processing fees, such as Stripe card processing, if the Artist chooses to accept card payments).

Any future fee schedule will be published on the platform and communicated to Artists via their registered contact information at least 30 days before taking effect (see Section 17). No fees will ever be applied retroactively.

For Clients: There are no platform booking fees charged to clients. The price shown at booking is the price set by the Artist (plus applicable tips at your discretion).

Section 5B: Payments

Clients pay Artists directly through the Artist's configured payment methods (such as Stripe, Cash App, Venmo, Zelle, or in-person payment). Deluge Beautee does not hold, collect, or disburse Artist earnings. Each Artist is responsible for their own payment collection per the methods they configure on the platform.

Section 5C: Non-Circumvention (Deluge Spaces)

If an Artist and a Salon Owner are connected through Deluge Spaces, any ongoing working arrangement between them that originates within 6 months of their first Deluge Spaces booking must continue to be processed through the Deluge Beautee platform for a period of 6 months from the date of first connection. After this 6-month period, both parties are free to arrange work independently. Violation of this clause may result in suspension or termination of platform access.

Section 5D: Artist Safety & Check-In

For the safety of both Artists and Clients, Artists are encouraged to use the platform's voluntary check-in feature when arriving at a booked location. Check-in is voluntary and does not constitute monitoring or control of the Artist's work. Deluge Beautee is not liable for any incidents that occur at service locations, whether or not the Artist has checked in.

Deluge Spaces: Salon Host Agreement

The following subsections (6–6G) apply specifically to Salon Hosts listing spaces on the Deluge Spaces platform.

Section 6: Deluge Spaces Overview

Deluge Spaces is a Deluge Beautee platform that allows salon owners ("Hosts") to list available workstations for use by independent beauty professionals ("Artists"). By listing a space on Deluge Spaces, Hosts agree to the following terms.

When listing a space on Deluge Spaces, Hosts agree to:

Section 6B: Station Types & Host-Set Rates

Hosts set their own rental rates. When listing a space, each Host chooses which station types to offer and sets the rental rate for each station type in their listing. Rates are displayed to Artists before booking: the rate shown at the time of booking is the rate that applies.

Hosts set the quantity available and the rental rate for each station type when listing. In addition to the Host's rental rate, Artists pay the 3% Deluge Beautee platform fee per booking (Section 6C). All fees are deducted automatically through the platform.

Section 6C: Platform Fee (Deluge Spaces)

Deluge Beautee charges both parties a platform fee of 3% per confirmed booking:

These fees are deducted automatically and cover platform infrastructure, booking management, payment processing, and quality standards enforcement.

Section 6D: Non-Circumvention

If a Salon Host and an Artist are connected through Deluge Spaces, any ongoing working arrangement originating within 6 months of their first booking must continue to be processed through the Deluge Beautee platform for 6 months from the date of first connection. After this period, both parties are free to arrange work independently. Violation may result in removal from the platform.

Section 6E: House Rules & Conduct

All Artists booking through Deluge Spaces agree to the following default house rules, which Hosts may supplement with their own additional rules in their listing:

If a Salon Host misrepresents their station type or fails to provide the supplies listed in their listing, the Artist has the right to report the discrepancy through the Deluge Beautee platform.

Upon a verified report, the Artist has two options:

Deluge Beautee reserves the right to conduct spot checks and verify listing accuracy at any time. Hosts found to have deliberately misrepresented their listing will be removed immediately regardless of offense count.

7. Tax Reporting

Each Artist operating on the Deluge Beautee platform is an independent contractor for tax purposes. Because clients pay Artists directly, Artists are solely responsible for tracking and reporting their income, paying applicable self-employment taxes, and complying with all federal, state, and local tax obligations. Deluge Beautee does not withhold taxes on behalf of Artists.

Where Deluge Beautee facilitates payments in a manner that meets IRS reporting thresholds (such as through Deluge Spaces transactions), Deluge Beautee will issue applicable tax forms (such as Form 1099) in accordance with IRS requirements. Artists should consult a qualified tax professional regarding their individual tax obligations.

8. Service Quality & Guarantees

Each Artist on the Deluge Beautee platform sets their own service guarantee and quality policy. Artists are encouraged to:

Clients should review each Artist's individual guarantee and cancellation policy, displayed on the Artist's profile and at the time of booking. Deluge Beautee does not set, enforce, or guarantee any minimum service standard on behalf of independent Artists.

Deposit requirements, amounts, cancellation windows, and rescheduling policies are set individually by each Artist and displayed at the time of booking.

16. Limitation of Liability

Deluge Beautee LLC is not liable for any indirect, incidental, or consequential damages arising from your use of our website, AI Nail Advisor tool, platform, or any services performed by independent Artists. Our total liability in any matter is limited to the amount of platform fees collected by Deluge Beautee on the specific transaction in question, or $50, whichever is greater.

We may update these Terms at any time. Continued use of our website or platform after changes are posted constitutes acceptance of the updated terms. Artists will be notified of material changes: including any introduction of platform fees: via their registered contact information with at least 30 days advance notice.

18. Governing Law

These terms are governed by the laws of the State of Missouri, United States.

19. Insurance Recommendation & Liability

Deluge Beautee LLC strongly recommends but does not require Artists to carry liability insurance. Artists are solely responsible for their own professional liability.
